1. Definitions
- Provider / we / us: Moi! Webservices.

Application: the website and related online functionality of Moi! Webservices, including account access
and parts you can use as an end user.
- User / you: the natural person who uses the Application or has an account.
2. What are these terms about?
These terms of use apply when you use the Application or access (parts of) the Application.
By using the Application, you agree to these terms.
If you also purchase products or services from Moi! Webservices (such as hosting, subscriptions or other paid services),
additional or separate terms may apply.
3. Account and access
- You are responsible for keeping your login credentials confidential and for activities carried out using your account.
- You will not use the Application for unlawful purposes or in a way that causes harm to others or to the Application.
- We may take measures in case of misuse or security risks, including limiting or blocking access, to the extent reasonable and necessary.
4. Your use and submitted content/data
- If you enter data or content into the Application, you remain responsible for its accuracy and lawfulness.
- You must not submit content that violates laws or regulations (such as copyright, privacy laws or criminal law).
- You follow reasonable instructions and security measures necessary for safe use.
5. Intellectual property and licence

All rights to the Application (including software, texts, designs and logos) remain with Moi! Webservices or its licensors.

You receive a non-exclusive, non-transferable right to use the Application for its intended purpose, as long as you comply with these terms.

Content you submit remains yours (or the rights holder’s). You grant us the right to technically process and store that content
to provide and secure the Application.
6. Acceptable use (abuse and prohibited actions)
- Bypassing, disrupting or testing security without permission is not allowed (such as scans, penetration tests or exploiting vulnerabilities).
- You must not use the Application for spam, malware, large-scale overload (DDoS) or other harmful activities.
- Automated use (such as scrapers/bots) is only permitted if we explicitly allow it.
7. Availability, maintenance and changes
- We aim to provide a reliable Application, but cannot guarantee uninterrupted operation.
- We may perform maintenance and change or (temporarily) disable functionality to ensure security, stability or updates.
- We may amend these terms. In case of material changes, we will inform you where reasonably possible.
8. Data, backups and export
- Where supported by the Application, you can manage and export data. You remain responsible for keeping your own copies and backups.
- We may create technical backups for continuity and recovery, but this is not a guarantee that data is always fully recoverable.
9. Suspension and termination
- We may suspend or terminate access if you breach these terms, in case of abuse, or where necessary for security or continuity.
- Where reasonable, we will inform you in advance. In serious situations (e.g. security incidents or unlawful activities) this may happen immediately.
- After termination, access to (parts of) data may lapse. Where practical and legally permitted, we may provide a limited period to export data.
10. Liability
We are only liable for damage if this follows from mandatory law. To the extent permitted by law, our liability is limited to

This limitation does not apply to liability that cannot be limited, such as damage caused by intent or wilful recklessness,
or other liability that is excluded from limitation by mandatory law.
11. Force majeure
We are not obliged to perform obligations if force majeure applies. Force majeure includes, among other things: disruptions in internet or telecom infrastructure,
power outages, failures at suppliers or third parties, government measures and other circumstances beyond our reasonable control.
12. Third-party services and links
The Application may contain links to third-party services or features that depend on third-party systems.
We are not responsible for third-party availability, outages or changes. Where applicable, third-party terms may apply.
13. Miscellaneous

Severability: if any provision is invalid, the remaining provisions remain in effect. The invalid provision will be replaced by a valid provision that most closely reflects the original intent.

Assignment: we may transfer our rights and obligations to a third party (e.g. in case of restructuring). Your rights are not transferable without our consent, unless the law provides otherwise.
14. Governing law
Dutch law applies to these terms. Any disputes will be submitted to the competent court,
unless mandatory law provides otherwise.
Additional provisions for specific functionality
Below are additional agreements and notes that only apply when you use certain parts of the Application.
Domain management via registry/API integrations
- This functionality allows you to perform bulk actions using your own access/credentials for registry or API integrations. This may have significant and irreversible consequences.

You are fully responsible for:
- managing and securing keys, tokens and access credentials;
- reviewing input, selected actions and filters, and confirming changes;
- assessing the impact of changes to domains, registrants, nameservers, transfers and renewals.
- You must not use this functionality for unauthorised, unlawful or misleading activities and you must comply with the terms of the relevant registry/provider.
- We provide this functionality “as-is”. To the extent permitted by law, we are not liable for damage caused by (i) incorrect input, (ii) unintended bulk actions, (iii) outages or limitations at registries/third parties, (iv) rate limits or blocks imposed by third parties, or (v) security incidents leading to unauthorised changes, except in cases of intent or wilful recklessness.
- To the extent permitted by law, we are not liable for loss of domain names, missed renewals or other consequential damage, except in cases of intent or wilful recklessness.
- In case of (suspected) abuse, security risks or unlawful activity, we may restrict access, block actions or suspend accounts to the extent reasonable and necessary.
